Art\u0131k konut kira art\u0131\u015flar\u0131 en fazla %25 yap\u0131labilmektedir. Bu oran\u0131n \u00fczerinden ev sahibi art\u0131\u015f yapamaz. Bu durum Temmuz 2024 y\u0131l\u0131na kadar ge\u00e7erlidir. Kira art\u0131\u015f\u0131 yapamayan ev sahipleri ise \u00e7\u00f6z\u00fcm\u00fc kirac\u0131lar\u0131n\u0131 \u00e7\u0131kararak aramaktad\u0131r. Kirac\u0131lar\u0131 \u00e7\u0131karman\u0131n en kolay yolu ise tahliye taahh\u00fctnamesidir. Kira s\u00f6zle\u015fmesi ile bo\u015f al\u0131nan tahliye taahh\u00fctnamesi sonradan doldurularak kirac\u0131lar\u0131 evden \u00e7\u0131karma riski ile kar\u015f\u0131 kar\u015f\u0131ya b\u0131rakmaktad\u0131r. Tahliye taahh\u00fctnamesinin kiralan\u0131n&nbsp;tesliminden sonra m\u0131 \u00f6nce mi&nbsp;d\u00fczenlenmi\u015f oldu\u011fu ise tahliye taahh\u00fctnamesinde yazan \u201ctaahh\u00fct ya da d\u00fczenleme tarihi\u201d olarak belirtilen tarihten anla\u015f\u0131labilir. Peki kiraya veren veya emlak\u00e7\u0131 kira s\u00f6zle\u015fmesinin imzaland\u0131\u011f\u0131 tarihte kirac\u0131dan \u201ctahliye tarihi\u201d ve \u201cd\u00fczenleme tarihi\u201d bo\u015f olarak ya da ileriki bir tarih doldurularak tahliye taahh\u00fctnamesi alm\u0131\u015f ise bu durumda kirac\u0131 kendini nas\u0131l koruyacakt\u0131r? Yani tahliye taahh\u00fctnamesi, kirac\u0131n\u0131n kiralanan\u0131 belirli bir tarihte bo\u015faltaca\u011f\u0131na dair imzalad\u0131\u011f\u0131 belgedir. Tahliye taahh\u00fctnamesi, kirac\u0131n\u0131n kiralanan ev veya i\u015fyerini belirli bir tarihte bo\u015faltmay\u0131 yaz\u0131l\u0131 olarak \u00fcstlendi\u011fi tek tarafl\u0131 bir s\u00f6zle\u015fmedir. Kirac\u0131n\u0131n bu imzal\u0131 belgesi, a\u015fa\u011f\u0131daki belirtilen ge\u00e7erlilik \u015fartlar\u0131n\u0131 sa\u011flamas\u0131 ko\u015fulu ile yasal olarak ge\u00e7erlilik kazanacak ve kiralanan\u0131n tahliye edilmemesi durumunda kiralayan yasal yollara ba\u015fvuru yaparak kirac\u0131y\u0131 icra ile \u00e7\u0131karabilecektir.&nbsp;<\/p>\n\n\n\n<p>Tahliye taahh\u00fcd\u00fcne dayal\u0131 tahliye davalar\u0131nda, di\u011fer tahliye sebeplerinden farkl\u0131 olarak s\u00f6zle\u015fmenin taraf\u0131 olmayan malikin dava a\u00e7ma hakk\u0131 bulunmamaktad\u0131r. Ancak kiralanan\u0131 iktisap eden yeni malik, TBK&#8217;n\u0131n 310 uncu maddesi uyar\u0131nca kiraya verenin kanuni halefi say\u0131ld\u0131\u011f\u0131ndan, \u00f6nceden verilmi\u015f taahh\u00fctnameye dayal\u0131 olarak dava a\u00e7abilir.<\/p>\n\n\n\n<p>Kiralayan isterse icra dairesine ba\u015fvurarak \u0130cra \u0130flas Kanunu 272. maddesi uyar\u0131nca tahliye istemli takip yapabilece\u011fi gibi, do\u011frudan sulh hukuk mahkemesinde de tahliye davas\u0131 a\u00e7abilir. Dava veya icra takibinin, taahh\u00fct edilen tahliye tarihinden itibaren bir ay i\u00e7inde yap\u0131lmas\u0131 gerekir. \u00d6rne\u011fin; kiralanan\u0131n 1\/8\/2010 tarihinde tahliye edilece\u011fi taahh\u00fct edilmi\u015fse, bu tarih gelmeden 31\/7\/2010 tarihinde dava a\u00e7\u0131lmas\u0131 veya tahliye istemli takip yap\u0131lmas\u0131 m\u00fcmk\u00fcn de\u011fildir. \u00c7\u00fcnk\u00fc, dava hakk\u0131 ancak taahh\u00fct edilen tarih itibariyle do\u011facakt\u0131r. Yine tahliye taahh\u00fctnamesi mutlaka kirac\u0131 taraf\u0131ndan verilmi\u015f olmal\u0131d\u0131r. Aile konutu ise e\u015fler birlikte imzalamal\u0131d\u0131r.<\/p>\n\n\n\n<p>Tahliye taahh\u00fctnamesinin ge\u00e7erlilik ko\u015fullar\u0131ndan bir di\u011feri ise yaz\u0131l\u0131 ve taahh\u00fcd\u00fcn kiralanan\u0131n tesliminden sonra verilmi\u015f olmas\u0131d\u0131r. Taahh\u00fctnamenin i\u00e7eri\u011finden, taahh\u00fcd\u00fcn kira s\u00f6zle\u015fmesinin yap\u0131ld\u0131\u011f\u0131 tarihten, yani kiralanana ta\u015f\u0131nd\u0131ktan sonra verildi\u011fi anla\u015f\u0131l\u0131yorsa bu durumda taahh\u00fctnamede tanzim tarihinin olmamas\u0131n\u0131n bir \u00f6nemi yoktur. Taahh\u00fcd\u00fcn ge\u00e7erli oldu\u011funun kabul\u00fc gerekir.<\/p>\n\n\n\n<p>TBK&#8217;n\u0131n 170 inci maddesi uyar\u0131nca, \u015fartl\u0131 tahliye taahh\u00fctnameleri d\u00fczenlenebilir. Bu durumda taahh\u00fct, s\u00f6z konusu \u015fart\u0131n ger\u00e7ekle\u015fmesi ile g\u00fcncellik kazanacakt\u0131r. Burada \u00f6nemli olan husus, \u00f6ng\u00f6r\u00fclen \u015fart\u0131n objektif olarak ger\u00e7ekle\u015febilir bir \u015fart olmas\u0131d\u0131r. Ba\u011fl\u0131 oldu\u011fu \u015fart\u0131n belirsiz ve gayri muayyen oldu\u011fu durumlarda taahh\u00fcd\u00fcn ge\u00e7erlili\u011finden s\u00f6z edilemez. Tahliye taahh\u00fctnamesi davas\u0131nda incelenecek deliller: kira s\u00f6zle\u015fmesi, tahliye taahh\u00fctnamesidir.<\/p>\n\n\n\n<p>Kira s\u00f6zle\u015fmesinin taraf\u0131 olmayan ki\u015finin, \u00f6rne\u011fin kefilin verdi\u011fi tahliye taahh\u00fcd\u00fc ge\u00e7erli de\u011fildir. Ancak kirac\u0131 ad\u0131na s\u00f6zle\u015fmeyi yapan ki\u015finin, kirac\u0131 ad\u0131na verdi\u011fi tahliye taahh\u00fcd\u00fcn\u00fc ge\u00e7erli kabul etmek gerekir. \u00c7\u00fcnk\u00fc s\u00f6zle\u015fmeyi kirac\u0131 ad\u0131na yapmaya yetkili ki\u015finin bu yetkisinin s\u00f6zle\u015fme ile ilgili tahliye taahh\u00fcd\u00fcn\u00fc de kapsad\u0131\u011f\u0131n\u0131n kabul\u00fc gerekir. Yani ortada bir tahliye taahh\u00fcd\u00fc olmas\u0131ndan \u00f6te hukuken ge\u00e7erli bir tahliye taahh\u00fcd\u00fcn\u00fcn bulunmas\u0131 tahliye i\u00e7in bak\u0131lacak ilk ve en \u00f6nemli husustur.&nbsp;<\/p>\n\n\n\n<p>Taahh\u00fcd\u00fcn bo\u015f ka\u011f\u0131d\u0131n imzalanmas\u0131 suretiyle verildi\u011fi veya tanzim tarihinin sonradan at\u0131ld\u0131\u011f\u0131na ili\u015fkin iddialar\u0131n HMK&#8217;n\u0131n 200 \u00fcnc\u00fc maddesi uyar\u0131nca tan\u0131k ve sair delille ispat\u0131 m\u00fcmk\u00fcn de\u011fildir. Bu t\u00fcr iddialar\u0131n, kesin delillerle kan\u0131tlanmas\u0131 gerekir. Taahh\u00fcd\u00fcn bo\u015f ka\u011f\u0131d\u0131n imzalanmas\u0131 \u015fekliyle verildi\u011fi veya tarihinin sonradan at\u0131ld\u0131\u011f\u0131na ili\u015fkin iddialar\u0131n\u0131n \u201cimza ya\u015f\u0131\u201d \u201cm\u00fcrekkep ya\u015f\u0131\u201d \u201cTelefon kay\u0131tlar\u0131\u201d \u201cHTS kay\u0131tlar\u0131\u201d \u201cd\u00fczenleme tarihinde ba\u015fka yer de oldu\u011funun veya kiraya veren ile tekrar bir araya gelmedi\u011fine dair\u201d ya da itirazlar&nbsp;incelenmeyecektir. Yarg\u0131tay Hukuk Genel Kurulu\u2019nun 1.7.1992 g\u00fcn ve 357 esas, 422 karar say\u0131l\u0131 karar\u0131nda a\u00e7\u0131k bir \u015fekilde ifade edilmi\u015f oldu\u011fu \u00fczere; tahliye taahh\u00fcd\u00fcndeki tarih k\u0131sm\u0131n\u0131n bo\u015f b\u0131rak\u0131lm\u0131\u015f olmas\u0131 onu tek ba\u015f\u0131na ge\u00e7ersiz k\u0131lmaz.
